A U.S. District Court judge has blocked the president’s ban on transgender military service, calling it unconstitutional and discriminatory. Judge Ana Reyes ruled the policy violates the Fifth Amendment, unfairly targets trans people, and uses derogatory language.

Reyes, an openly lesbian judge appointed by Biden, highlighted a pattern—leaders have used military readiness as an excuse to exclude marginalized groups, from Black people and women to LGBTQ+ individuals. Now, trans people are the target, she wrote in her 79-page ruling.

The ban was rushed. Seven days after taking office, the president announced it. Thirty days later, Defense Secretary Pete Hegseth implemented it—without consulting military leaders or providing data. The policy even claimed trans service members lack honor and discipline, claims government lawyers later admitted were "pure conjecture."

Trans people have served openly since 2021. Under questioning, federal attorneys conceded trans soldiers meet military standards and serve honorably. Reyes said the ban has caused "irreparable harm" and argued trans people deserve legal protection.

“The cruel irony,” Reyes wrote, “is that thousands of transgender service members have risked their lives to protect the very equal rights this ban seeks to take away.”

The lawsuit was brought by six active-duty members and two individuals seeking to enlist. Collectively, they have over 130 years of service and 80 commendations. Defense attorneys didn’t even argue they were unfit to serve.

Reyes slammed the ban as "rushed and haphazard," causing chaos and undermining military cohesion. It contradicts established policy and unfairly singles out those with gender dysphoria while allowing others with treatable conditions to serve.

The Defense Department’s justification? Reyes called it “inexplicably misleading.” The studies they cited didn’t assess trans service members already deemed fit. One study even found trans distress comes from discrimination—not being trans. Gender-affirming care, it said, improves well-being.

Reyes debunked cost concerns. The military spent $41 million on Viagra in 2023—compared to just $5.2 million on gender-affirming care, only 0.00057% of the 2024 budget. Past policies like "Don’t Ask, Don’t Tell" cost taxpayers over $600 million by discharging LGBTQ+ troops.


She mocked the administration’s priorities: “The president’s ban on paper straws contained more reasoning and scientific backing than this military ban.”

Reyes acknowledged legal appeals are likely but said her ruling preserves the current policy allowing trans people to serve without disrupting operations.

“The Court’s opinion is long, but its premise is simple,” she wrote. “All people are created equal. All means all. Nothing more. And certainly nothing less.”

Plaintiff Army Reserves 2nd Lt. Nicolas Talbott reacted with relief. “This is all I’ve ever wanted to do. This is my dream job. I was terrified I was about to lose it.”

Jennifer Levi of GLBTQ Legal Advocates & Defenders called the ruling a victory for service members defending the nation. “The Court’s findings lay bare how this ban targets and undermines courageous troops. We are confident this ruling will stand strong on appeal.”

Two other legal challenges against the ban remain active in other courts.
